Big differences in sentencing child porn offenders from case to case

Not everyone is getting sentenced the same way – if they’ve been convicted of a sex offense involving child porn – by judges in U.S. courts, according to Pete Yost with the Washington Post.

Here’s what the U.S. Sentencing Commission has to say about the law against child pornography: that it needs to change.

And here’s how:

  • Volume: How big is a defendant’s collection?
  • Type: What is the type of sexual conduct?
  • Age: How old are the persons depicted in the video or images?
  • Length: How long has a defendant maintained his or her collection?
  • Involvement: Is the defendant a webmaster, for example, or a “leader” in an online community dedicated to child porn?

The Commission argues that judges should be able to take these factors into consideration during sentencing, given the differences, say, between someone who’s is said to be a “webmaster” versus someone accused of possessing a few images.
