Man gets 20 years with 15 suspended for fatal DUI crash

A Maryland man has been sentenced to 20 years in prison for his role in a fatal accident that killed his young son, but 15 of those years have been suspended by the court. As a result, the man will spend only five years behind bars for the traffic crimes. The 28-year-old man had pleaded guilty to a variety of charges in connection with the accident, including aggravated involuntary manslaughter. He was also accused of DUI after the November wreck.

Official reports show that the defendant admitted to drinking alcohol before driving with his two children in the car. Investigators were not able to obtain a blood sample until six hours after the crash; at that time, the man’s blood alcohol content measured at 0.05 percent. Analysts said that the man’s blood alcohol content level would likely have been at about 0.11 percent at the time of the wreck.

Although scientific analysis for BAC level is rather sophisticated, it is not foolproof. In most states, time limits have been established for administering blood and Breathalyzer tests. For instance, officers are not permitted to obtain physical samples after a certain number of hours have passed, largely because the results are less reliable. It is not clear whether those rules were followed in this instance.

The collision occurred after the defendant went to pick up his children — a 3-year-old girl and 7-year-old boy — at a local daycare. Family members notified police because the man had been drinking at a party before he got behind the wheel. The defendant reportedly caused two separate crashes in Interstate 95, first striking the rear-end of another vehicle and then eventually plowing into a grove of trees. Officers said they found marijuana in the man’s vehicle and that he was intoxicated at the time of the collision.
