Don't take their word for it: Blood test results in DUI cases not always reliable

This case happened out of Colorado, but it could conceivably happen anywhere: Blood tests for alcohol content are touted by prosecutors as being reliable for use as evidence in drunk-driving cases. But, as CBS Denver reports, 1,700 samples have to be re-tested because a lab employee has misreported results.

According to a local DUI-defense attorney whose clients were apparently impacted, the analyzed blood samples were reported “outside the appropriate reporting range.” In some cases, the blood alcohol content reported was higher than actual.

This is a big deal in DUI cases, where drivers accused of the offense are convicted largely on the basis of being above the legal limit to drive. Obviously, if the analysis of a blood sample was not done correctly, the question of guilt after a conviction is called into question.

As CBS Denver reports, one official said, “We could not verify the quality of the work he was doing in the lab,” and whether the lab technician screwed up by accident or did it on purpose.
