What Is Underage Drinking or Minor in Possession?
It is illegal for anyone to possess or drink alcohol if they are under 21 years of age. If your child is found to have a blood alcohol content (BAC) of .02, he or she can be charged with underage drinking. If your child is driving, he or she can be found guilty of driving under the influence with a BAC of .02. The legal limit for adults is .08.
Minors are often intimidated by police and provide incriminating information when they have no legal obligation to do so. For example, when stopping your child, a police officer may ask if he or she has been drinking. If your child answers that he or she had a few beers, that could lead to criminal charges because a small amount of alcohol can result in a BAC of .02.
Unfortunately, underage drinking and minor in possession are misdemeanors, which will result in a criminal record. My goal as your child's lawyer is to prevent a mistake from having lifelong consequences.
